Pro.Charles Kambanda: Kagame junta does not seem to know the difference between provisional bail release and commutation! Absurd but true. Refer to the Commutation Decree hereto:

PRESIDENTIAL ORDER Nº 131/01 OF 14/09/2018 EXERCISING THE PREROGATIVE OF MERCY We, KAGAME Paul,President of the Republic,Pursuant to the Constitution of the Republic of Rwanda of 2003 revised in 2015, especially in Articles 109, 112 and 176;Pursuant to Law nº 30/2013 of 24/5/2013 relating to the Code of Criminal Procedure, especially in Articles 236, 237, 238, 239, 240, 241 and 243;

HAVE ORDERED AND ORDER: Article One: Grant of mercy The remainder of the sentence Ms.INGABIRE Victoire Umuhoza, who wasconvicted and sentenced to fifteen (15) years of imprisonment by the Supreme Court in case N0 RPA 0255/12/CS is hereby wholly commuted.

Article 2: Conditions to be fulfilled by the grantee of mercy The grantee of mercy indicated in Article One of this Order shall comply with the following conditions:
1 º shall report to the Primary Level Prosecutor of her place of residence, at the prosecution office and notify the Prosecutor of the Village, Cell, Sector and District of her residence, within fifteen (15) days from the date of publication of this Order in the Official Gazette of the Republic of Rwanda;

2 º shall appear before the Primary Level Prosecutor of her place of residence, at the prosecution office, once a month, on a day determined by the Primary Level Prosecutor. In case of impossibility of appearance on the determined day, she shall request not to appear in a reasoned letter addressed to the Prosecutor in advance. The Prosecutor shall respond within three (3) days. If the prosecutor does not respond, it will be

Article 4: Effects of revocation of the grant of mercy Upon revocation of the grant of mercy, the grantee shall serve, in prison, the remaining part of the sentence, which shall be counted from the day the grant of mercy is revoked.

Article 5: Varying or lifting conditions Conditions provided in Article 2 of this Order may be varied or lifted depending on the conduct of the beneficiary of the pardon.
The grantee of mercy, herself, requests for the variation or lifting of the conditions. She addresses a written reasoned request to the President of the Republic, with a copy to the Minister having justice in his attributions. The Minister gives his or her opinion to the President of the Republic,immediately after receiving the copy.

Article 6: Authorities responsible for the implementation of this Order The Prime Minister and the Minister of Justice are entrusted with the implementation of this Order.

Article 7: Repealing provision All prior provisions contrary to this Order are repealed.

Article 8: Commencement This Order comes into force on the date of its publication in the Official Gazette of the
Republic of Rwanda.
